2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 366A/34, 341 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, petitioner kidnapped 14 years minor sister of the informant.
4. Learned counsel appearing for the petitioner submits that the victim in her 164 Cr.P.C. statement has not corroborated the prosecution case. She has stated that she was in love with the petitioner and out of sweet will, she went to Nepal along with him and they have solemnized marriage and are leading a happy martial life. Medical Board has assessed her age to be 17 to 19 years.

5. Considering the 164 Cr.P.C. statement of the victim, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act, Supaul in Bhaptiyahi Police Station Case No. 205 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
