The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ekchari P.S. Case No. 04 of 2015 registered under Sections 147, 148, 149, 341, 323 and 379 of the I.P.C. and 27 of the Arms Act. The allegation of informant Surendra Mandal is that 10 persons, including the petitioner named in the F.I.R. reached at the field started firing and looted 30 bags of wheat and took away silver chain of his wife.

Learned counsel appearing on behalf of the petitioner submits that both the parties are co-vllagers. It is also submitted that, in fact, there is land dispute in between the parties, due to that reason, petitioner has falsely implicated in this case. Moreover, there is no specific overt act against the petitioner about carrying 30 bags of wheat and also snatching of silver chain of informant's

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Bhagalpur in connection with Ekchari P.S. Case No. 04 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
