JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2019 This application, for grant of anticipatory bail, arises out of Chhatapur P.S. Case No. 248 of 2017, disclosing offences under Sections 406, 420 and 379 of the Indian Penal Code. Prosecution story in brief is that informant went to withdraw his money from the ATM but money could not be withdrawn as there was no balance in his account, thereafter, he contacted the bank and came to know that the entire amount of the informant has fraudultenty been transferred in the account of the petitioner and she had also withdrawn the money. Submission of learned counsel for the petitioner is that she herself is victim in this case and she has also given a legal notice to the Bank Manager stating that an amount of Rs. 40,000/- has been transferred from her account to the account of the informant and Rs. 48,000/- in some other account and when

Patna High Court CR. MISC. No.24615 of 2019(4) dt.26-06-2019 2/2 no reply was given, the petitioner has filed a complaint case in the court of Chief Judicial Magistrate, Bhojpur against the Branch Manager and the informant, which was referred for institution of F.I.R. and on the basis of same Sahpur P.S. Case No. 28/18 was registered.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additinoal Chief Judicial Magistrate -IV, Supaul, in connection with Chhatapur P.S. Case No. 248 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
