Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code.

As per the prosecution case, the informant got information that one unknown person is being assaulted by villagers by mistake as child lifter and after some time he died. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is not named in the FIR and his name transpired in this case during the course of investigation upon alleged

Patna High Court CR. MISC. No.32008 of 2021(2) dt.06-01-2022 2/2 identification by a spy from an alleged viral video of occurrence. There is no specific allegation against this petitioner. Similarly situated accused have already been granted bail by this court. Petitioner claims clean antecedent and is in custody since 21.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Pipra PS case No.310/2019.
