Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 337, 307, 427, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

For land dispute between the parties, other criminal cases are also going on. Specific allegation against the petitioner is that he gave a blow with an iron rod at the head of the informant, as a result whereof, he fell down. Submission is that the doctor has found simple injury. Petitioner is in custody since 27.02.2019. Investigation of

Learned counsel for the informant opposed the prayer for bail on the basis of nature of allegation against the petitioner.

Considering the entire facts, especially the fact that there is no allegation of repetition of blow against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Araria Police Station Case No.197 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
