Heard both sides.

The petitioners apprehend their arrest in Aurangabad (Mufassil) P.S. Case No. 17 of 2017 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code, under Section 4/44 of the Bihar Minerals Concession Act, 1972, Sections 3, 4 and 5 of Illegal Mining Transportation and Storage Rule 2003 and Sections 33, 41 and 42 of the Forest Act. The police intercepted two trucks bearing Registration No. HR-38H-2675 AND UP-61T-1314 loaded with chips. It is alleged that the truck drivers were carrying chips without any

Learned counsel for the petitioners submits that petitioner no. 1 is owner and petitioner no. 2 is driver of the truck. The petitioners have got valid papers for carrying chips. Considering the facts aforesaid and nature of allegations, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad (Mufassil) P.S. Case No. 17 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
