JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Masaurhi P.S.Case No. 465 of 2019 for the offences punishable under Sections 341, 342, 323, 337, 506, 307/34 of the Indian Penal Code.

As per prosecution, the accused persons including the petitioner assaulted the informant with belt, bricks, stone and country made katta due to which the informant sustained head, hand and lip injury.

Learned counsel for the petitioner submits that petitioner is falsely implicated in this case. No specific allegation is attributed against the petitioner. Similarly situated co-accused namely, Vivek Kumar @ Vivek Raj has been

Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st class, Masaurhi in connection with Masaurhi P.S Case No. 465 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
