JUSTICE SUDHIR SINGH ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302/201/34/120(B) of the Indian Penal Code. It is alleged by the informant that on 21.09.2015 at 1.00P.M. the petitioner called the son of the informant and took him away on the pretext of meal but the son of the informant did not return till evening. Then the informant went and asked but the petitioner and his family members denied to disclose the address of the son of the informant.
It is submitted on behalf of the petitioner that the petitioner is in custody since 31.03.2016.The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the
Patna High Court Cr.Misc. No.26259 of 2016 (3) dt.24-08-2016 2/2 petitioner. As per FIR it is a case of last seen. There is no eye witness to the alleged occurrence.
On behalf of the State it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siwan Town P.S.Case No. 507 of 2015.
