JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2018 The petitioner seeks regular bail in connection with Nadi P.S. Case No. 117 of 2018, registered for offences punishable under Section 366(a) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that the statement of girl recorded under Section 164 Cr.P.C., which is Annexure-2 to this petition, in which the girl herself has stated that she has love affair with the petitioner and with her own consent she had gone away with the petitioner and married with him and the petitioner is in judicial custody since 12.07.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court Cr.Misc. No.68072 of 2018(2) dt.29-11-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Vth, Patna City, in connection with Nadi P.S. Case No. 117 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
