Petitioner seeks bail in a case registered under section 395 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, it was detected that the petitioner was using looted mobile phone and after that petitioner was caught from his house and looted mobile phone was recovered from his possession. Petitioner disclosed that he had purchased the aforesaid mobile from one Md. Nahsim and after that the aforesaid Md. Nahsim was arrested and he, too, accepted this fact that he had sold looted mobile to the petitioner. The above stated fact has specifically been mentioned by the petitioner at paras 10 and 11 of the petition. Petitioner does not have any criminal antecedent and is languishing in jail custody since 10.7.2016.

Patna High Court Cr.Misc. No.44790 of 2016 (2) dt.18-10-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Dagarwa P.S. Case no. 49/2016.
