JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-07-2025 At the outset, the learned counsel for the opposite parties submits that in pursuance to the order of this Court dated 23.9.2022, passed in CWJC No. 9466 of 2021, the encroachment in question has been removed on 19.4.2023. 2.

However, the learned counsel for the petitioner submits that in fact, the encroachment has not been removed, hence seeks liberty on behalf of the petitioner to approach the Circle

Patna High Court MJC No.903 of 2023(4) dt.25-07-2025 2/2 Officer, Lauriya, West Champaran at Bettiah for redressal of his subsisting grievances. Liberty, so sought, is granted. 3.

It is needless to state that in case appropriate petition is field by the petitioner before the Circle Officer, Lauriya, West Champaran at Bettiah in terms of the provisions contained in the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the Circle Officer, Lauriya, West Champaran at Bettiah shall examine the same, if required issue notices to the alleged encroachers and after considering their objections, shall pass the final order under Section 6(1) Bihar Public Land Encroachment Act, 1956, in accordance with law, within a period of six weeks, thereafter.

Accordingly, the present contempt petition stands disposed off on the aforesaid terms.
