JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Laukaha P.S. Case No. 37 of 2014 instituted under Sections 341, 323, 504, 498A, 506/34 of the Indian Penal Code.
Heard learned counsel for the petitioner, learned counsel for the informant and the State.
The prosecution story, in brief, is that in spite of P.R. bond made by the petitioner as referred therein, the petitioner and other accused persons subjected her to cruelty in different ways and ultimately, they ousted her from her matrimonial house with her children as the petitioner is an unemployed person and he is in touch with bad people and thereafter they did not make any search of her and her children. It is also alleged that the informant came to know that
Patna High Court Cr.Misc. No.1355 of 2015 (3) dt.08-05-2015 remarriage of the petitioner is to be organized with the daughter of Rama Kant Sah.
It is submitted on behalf of the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It has further been submitted that the allegation made in the First Information Report is not correct. On behalf of the State and the counsel for the informant, it is submitted that the petitioner is the husband of the informant and he has been harassing the informant for no fault of her Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No.
37 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. It is further direction that the petitioner shall deposit an amount of Rs. 2,000/- per month before the learned court below, which shall be released in favour of the informant. (Sudhir Singh, J) P.K.
