This application has been filed for modification of order dated 10.07.2020 passed in Cr.Misc. No. 20458 of 2020 for confirmation of provisional bail. By the said order, petitioner was granted anticipatory bail provisionally, which was to be confirmed by the learned Court below on certain terms and conditions.
Learned counsel for the petitioner submits that petitioner has already deposited Rs. 3,08,822/- through bank draft and the same has been accepted by Block Development Officer, Garharn, Bhojpur, vide Letter no. 1094 dated 30.08.2022 (Annexure - 3) and thereafter, suspension of petitioner was withdrawn and he was allowed to join the school
Patna High Court CR. MISC. No.26150 of 2023(2) dt.28-06-2023 2/2 in upgraded Middle School Bahri, Block Garharni, District - Bhojpur. Accordingly, he prays that provisional anticipatory bail, which was earlier granted to the petitioner, be confirmed. Since the petitioner has already deposited the said amount, which was accepted by the concerned B.D.O. and suspension of the petitioner has already been revoked and he was allowed to join the school, the present modification petition is allowed and the learned Court below is directed to confirm the provisional anticipatory bail of the petitioner, which was granted to him, vide order dated 10.07.2020 passed in Cr.Misc. No. 20458 of 2020.
