Petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 214 of 2018 registered for the offence punishable under sections 420 and 414 of the Indian Penal Code, Section 27(b)II, 28 and 28(A) of the Drugs and Cosmetics Act and Section 36 A.C. of the Amendment Act, 2008 . Learned counsel appearing for the petitioner submits that merely on misconception, petitioner has falsely been implicated in this case. Petitioner is having a valid license for preparation of Oxytocin injection as is evident from Annexure 2. After expiry of license, petitioner filed a challan after paying the requisite amount for renewal of the same as is evident from Annexure-3. Petitioner has not been found selling

Patna High Court Cr.Misc. No.75832 of 2018(2) dt.20-12-2018 2/2 or buying Oxytocin Injection.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 214 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
