Heard counsel for the State.
The four petitioners herein seek anticipatory bail in Turkaulia P.S. Case No. 419 of 2015 registered under section 307 IPC. While the informant was sitting at his Darwaza along with his son and daughter, the accused persons came to his Darwaza and it is alleged that petitioner no.1 inflicted injury by means of iron rod on the head of the informant which was warded off. There is also allegation against petitioner no.4 that he assaulted by means of Farsa causing cut injury on the head of his son. The rest of the accused persons, it is alleged, had formed part of the mob.
Patna High Court Cr.Misc. No.44170 of 2015 (2) dt.16-10-2015 2/2 Considering the allegation contained in the FIR as also reflected from the impugned order, I am not persuaded to grant anticipatory bail to petitioner nos. 1 and 4 namely Prawez Ansari and Shahzad Ansari. Their prayer is rejected. So far as petitioner nos. 2 and 3 namely Hajuddin Ansari and Reyazul Ansari against whom there is no direct allegation and no criminal antecedents, in the event of arrest/surrender within four weeks from today, they shall be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction CJM, East Champaran at Motihari in Turkaulia P.S. Case No. 419 of 2015 on condition that one of the bailors shall be their own/close family members. In the event of framing of charge, they shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel their bail bonds.
