JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners. The petitioners are apprehending their arrest in connection with Teghra P.S. Case No. 187 of 2016 registered for the offences under Section 355(A) of the Indian Penal Code. It has been submitted on behalf of the petitioners that though there is allegation that the petitioners and another had forcibly took away the daughter of the complainant- Poonam Devi, but it also appears that earlier she had also lodged a case against Karan Kumar and his parents for kidnapping of Rima Kumari which Rina Kumari in her statement recorded under Section 164 Cr. P.C. denied the prosecution case and she wanted to live in her parents house and she is living there. Heard the learned the learned APP also.
Having heard both sides and considering the facts and circumstances of the case, let the petitioners, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/-
Patna High Court Cr.Misc. No.4245 of 2017 (2) dt.09-02-2017 2/2 each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 187 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the further conditions that the petitioners shall co-operate in the trial and make himself available before the court as and when required and in the event of failure on their part to appear before the court on two consecutive date, without showing any genuine reason, the prosecution is free to move for cancellation of his bail (Vinod Kumar Sinha, J) BTiwary/- U T
