2. The petitioners are apprehending arrest in connection with Maner P.S. Case No. 180 of 2022 lodged on 07.03.2022, for the offence punishable under Sections 341, 323, 354, 307, 379, 504, 506 & 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioners against whom there is an allegation that they have assaulted the informant's side and also snatched golden chain, ring along with
Patna High Court CR. MISC. No.23660 of 2025(2) dt.05-05-2025 2/3 Rs.10,000/- cash.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that both the informant's side and petitioners' side are family of agnates. Counsel submits that the informant is the gotni of petitioner nos.1 and 2 and aunt of petitioner nos.3 and 4. Counsel submits that for the same date and place of occurrence, two FIRs have been lodged i.e. one FIR has been lodged from the petitioners' side bearing Maner P.S. Case No. 172 of 2022 indicating that the dispute started for the purpose of taking water from chapakal due to which scuffling took place from both the sides and the present case has been lodged from the informant's side bearing Maner P.S. Case No. 180 of 2022. Counsel further submits that petitioners have no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that petitioners have no criminal antecedent and both the parties are family members.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond
Patna High Court CR. MISC. No.23660 of 2025(2) dt.05-05-2025 3/3 of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Danapur, Patna, in connection with Maner P.S. Case No. 180 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
