Petitioner is languishing in custody since 27.09.2016 in connection with C.C. Case No. 490/16 for offences punishable under Section 47(a) of Bihar Excise (Amendment) Act, 2016.

The prosecution case, as lodged by the ASI of the Excise Department, is that on secret information the officials found six litres of illegal country made wine in the bag of the petitioner. It has been submitted by the learned counsel for the petitioner that he is innocent and a person of 65 years of age. He has not committed any offence and has no criminal antecedent.

Be that as it may, considering the facts aforesaid and submission of the parties, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Kishanganj, in connection with C.C. Case No. 490/16.
