Petitioner seeks bail in a case registered under sections 364, 379/34 of the Indian Penal Code.
Petitioner is named in the first information report but only suspicion was raised against him and others on the basis of the previous enmity. However, in course of investigation, FIR named accused Dhipla was arrested and police took him on remand and interrogated him. Thereafter co- accused Dhipla disclosed about involvement of the petitioner which is evident from perusal of para 71 of the case diary and except the aforesaid so-called disclosure of coaccused as well as suspicion, there is nothing against the petitioner. Investigation against him has already been completed. No doubt, petitioner does have criminal antecedent of
Patna High Court Cr.Misc. No.44269 of 2016 (5) dt.10-01-2017 several cases but in the present case, except the above stated materials, there is nothing against him.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Mufassil P.S. Case no. 377/2015. shahid (Hemant Kumar Srivastava,J) U T
