Having regard to the fact that the petitioner is facing prosecution for the offences punishable under Sections-406 and 420 of the Indian Penal Code and he claims to be an employee of Shine India, a non banking company which is said to have misappropriated sum of Rs. 32 lacs as alleged by the informant, this Court in absence of any proof for such non banking company namely, Shine India that it had the authority and license by the Reserve Bank of India to function as non banking company will have no difficulty in holding that any other person attached to the company who are said to be the party in collecting money from poor people would

Patna High Court Cr.Misc. No.51094 of 2014 (2) dt.14-05-2015 never be entitled for the privilege of anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.

Nothing said in this order, however, will come in the way of the petitioner in surrendering before the Court below and praying for regular bail.
