JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 13-01-2016 The grievance of the petitioner for which the writ application was filed relating to non- deposit of TDS with the Income Tax authorities and if deposited not being uploaded on the website, which has caused problems for the petitioner, stands corroborated by the stand of the University taken in the counter affidavit filed from time to time including the third counter affidavit served today. It is only now that the details of the deduction etc. have been uploaded on the website of the Income Tax authorities and communication made to the Assistant Commissioner, Income Tax Department, Circle- 2(1), Muzaffarpur.

If this be so then in case the Income Tax authorities creates any liability upon the petitioner because of the default on the part of the University authorities, the University authorities will have an obligation to compensate the petitioner in this regard.
