The petitioner apprehends his arrest in connection with Nagar (Sahyak) P.S. Case No. 616 of 2016 registered under Sections 341, 323 and 307/34 of the Indian Penal Code. The accusation is that due to land dispute three persons named in the F.I.R. including the petitioner came to the house of the informant and started to assault his father and brother. At that time, Triloki Ram gave bamboo blow at the neck of Sonu Kumar, brother of the informant, who sustained grievous injury. Thereafter, Sonu Kumar, brother of the informant, rushed to Sadar Hospital, from where, he was referred to Katihar Medical College and from there to Siliguri.
Patna High Court Cr.Misc. No.54003 of 2016 (2) dt.21-12-2016 Learned counsel for the petitioner submits that it would appear from the F.I.R. that while the petitioner is named in the F.I.R. along with two others but there is specific allegation against Triloki Ram to cause injury at the neck of Sonu Kumar, brother of the informant. It is further submitted that moreover, the injuries as detailed in paragraph 28 of the case diary, in which, description about nature of injury has not been disclosed. It is further submitted that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Nagar (Sahyak) P.S. Case No. 616 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
