Heard Mr. K.K.Singh, learned counsel for the petitioner and Mr. Anant Kumar, learned Additional Public Prosecutor, appearing on behalf of the State.
Having considered the averments made in the application and having heard the learned counsel for the petitioner, I am satisfied that the absence of the petitioner and/or their counsel from the Court, on 08.09.2016 was for reasons beyond their control.
In view of the above and in the interest of justice, the restoration application is allowed and Cr.Misc. No. 36042 of 2016, aforementioned is hereby restored to its original file. This restoration application shall, accordingly, stand disposed of.
