JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 Petitioner prays for bail in connection with Bakhtiarpur P.S.Case No. 258 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 384, 504 and 506 of the Indian Penal Code. Allegation as per FIR is that petitioner caught hold of the informant and co-accused stabbed him brutally and there is also allegation of stabbing to brother of informant, who later on succumbed to the injuries.

Submission of learned counsel for the petitioner is that only allegation against the petitioner is of catching hold of the informant and there is no other allegation against him and he is in custody since 4.9.2018 and further submission is that petitioner is an old person aged about 65 years.

Patna High Court Cr.Misc. No.71895 of 2018(2) dt.07-12-2018 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case, petitioner may renew his prayer for bail.

With the above observation, this application is dismissed.
