====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-02-2022 Heard the parties through video conferencing. Petitioner, who is in custody since 20.02.2021, seeks regular bail in connection with Buxar Mahila P.S. Case No. 117 of 2020 registered for offence punishable under Sections 341, 323, 504, 506, 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The present case is the dispute between the husband and wife.

Learned counsel appearing on behalf of the informant submits that the O.P. No. 2 is ready to live along with the petitioner if the petitioner keeps her with full dignity and honour and provides her all the necessary amenities and supports her financially.

No.32520 of 2021(5) dt.04-02-2022 2/3 Learned counsel appearing on behalf of the petitioner Sri Ram Chandra Singh submits that the petitioner is ready to keep his wife and as such the petitioner may be released on provisional bail for a certain period with a condition that if the petitioner does not keep her with dignity and honour then his bail bond shall be cancelled.

Considering the submissions made by the parties and taking into consideration that there is every chance of patching up of the matrimonial relationship between the petitioner and his wife (O.P. No.2), the petitioner above named is directed to be released on provisional bail for a period of one year upon furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Mahila P.S. Case No. 117 of 2020 on such terms and conditions as imposed by the Court below. If the Court below finds that there is no complaint on behalf of either the parties who are husband and wife and they are living happily with each other, the bail application of the petitioner will be confirmed on such terms and conditions as imposed by the Court below.

In case, the conduct of either of parties is not

With above observation, the present bail application is disposed of.
