JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Complaint Case No. 36 of 2016 registered under Sections 498A, 323/34 of the I.P.C. and 4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of demand of dowry.

Submission is that petitioner is husband of the complainant and ready to keep his wife peacefully. It is also submitted that prior to this case, complainant has also filed two

Patna High Court Cr.Misc. No.51568 of 2016 (2) dt.22-12-2016 2/2 Complaint Cases for the same offence under Sections 323, 504, 506, 498A of the I.P.C. and section 4 of the Dowry Prohibition Act. It is further submitted that petitioner has no criminal antecedent and is in custody since 29.08.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Bikramganj, Rohtas in connection with Complaint Case No. 36 of 2016.
