JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody in connection with Chapra Town P.S. Case No. 340 of 2016 for the offences punishable under Sections 147/148/149/341/323/307/302/504 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners and others variously armed came to the land of the informant to put the boundary wall. When protest was made, co-accused Mintu Giri fired from his gun causing injury to the father of the informant Rabindra Giri as a result whereof he succumbed.

Allegation against the petitioners and others is of

Patna High Court Cr.Misc. No.53191 of 2016 (2) dt.08-12-2016 2/2 commission of assault with lathi to different persons. Considering the nature of allegation against the petitioners, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran/Successor Court, in connection with Chapra Town P.S. Case No. 340 of 2016.
