JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 427, 323 and other allied sections of Indian Penal Code.
As per prosecution case, 19 FIR named accused persons including this petitioner as also 50-60 other unknown accused persons came at the house of the informant armed with lathi, sword and assaulted the informant and his grand father as a result of which his grand father sustained injuries and was taken to hospital where he died.
Learned counsel appearing for the petitioner submits that allegation of assault against the petitioner is general and omnibus. There is case and counter case in which both the sides

It is further submitted that after investigation this petitioner along with Munna Ram and Sonu Kumar have not been sent to trial. Petitioner has got clean antecedent. Considering the nature of accusation and fact that police after investigation has submitted final form coupled with the fact that petitioner has got clean antecendent, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhabua (Kaimur) in Mohania P. S. Case No. 605 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
