Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the complainant. It is next submitted that petitioner is husband of the complainant and from perusal of allegation as alleged in the complaint, it would manifest that the same is general and omnibus in nature. It is

No.26146 of 2024(2) dt.09-05-2024 2/3 further submitted that on intervention of well-wishers, the petitioner and the OP No. 2 resolved their dispute amicably by way of one time settlement and the petitioner paid an amount of Rs. 8 lakhs to the complainant by way of cheque. It is next submitted that complainant has already performed her second marriage as such no useful purpose would be served by keeping the case pending.

Learned A.P.P. for the State fairly submits that from perusal of Annexure-2 to the anticipatory bail application, it appears that the parties have compromised.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 23 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, the OP No. 2 shall be at liberty to file an application seeking cancellation of the anticipatory bail granted
