JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-07-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Bachhwara P.S. Case No. 127 of 2019 for offences under Sections 147, 148, 149, 323, 379, 307, 504 and 506 of the

Patna High Court CR. MISC. No.21122 of 2020(2) dt.08-07-2020 2/3 Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedents. He further submits that on account of the dispute about digging of ditch on the land of the informant, scuffle took place between the parties. It is further submitted that in this case co-accused, namely, Ramesh Rai and Lalit Rai against whom there is specific allegation of firing, have been granted bail by a coordinate Bench of this Court vide order dated 23.10.2019 passed in Cr. Misc. No. 62011 of 2019.

Considering the aforesaid, this Court is inclined to grant bail petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 127 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to further condition that on release, the petitioners shall render their services as volunteers in the District Health Centre for a period of one month in dedicated Covid hospital.
