The petitioner seeks bail in connection with Ahiyapur P. S. Case No. 1197 of 2019 dated 05.10.2019 instituted for the offences under Sections 302, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

Patna High Court CR. MISC. No.21129 of 2020(2) dt.07-07-2020 2/3 From the perusal of the F.I.R., it appears that the informant suspected the hands of the petitioner and her husband in having conspired to kill the deceased, who is the father of the informant.

It has been submitted on behalf of the petitioner that the husband of the petitioner, against whom there is similar allegation, has been granted bail by a Bench of this Court vide order dated 29.02.2020 passed in Cr. Misc. No. 13588 of 2020.

The petitioner is in custody since 28.01.2020. It has been submitted that petitioner has been made accused in this case because she happens to be the Mukhiya of the concerned Panchayat.

The petitioner was earlier made an accused in a case under Sections 420 and 467 of the Indian Penal Code. Considering the afore-stated facts, taking into account that there is no eye-witness to the occurrence and a co-accused with similar allegation has been granted bail, the petitioner, above-named, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000 /-

Patna High Court CR. MISC. No.21129 of 2020(2) dt.07-07-2020 3/3 (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P. S. Case No. 1197 of 2019.

The petition stands allowed.
