The petitioners apprehend their arrest in Complaint Case No. 705 of 2010 registered for the offences punishable under Sections 323, 314, 406, 498(A), 494 and 504 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act. The complainant alleged that the petitioner no. 1 solemnized love marriage with her on 03.05.2009 in a temple, but thereafter her husband, father-in-law and mother-in-law started subjecting her to physical and mental torture due to nonfulfillment of demand of dowry. It is submitted that petitioner no. 1 never solemnized any marriage with the complainant. The notice was issued to the
Patna High Court Cr.Misc. No.51396 of 2014 (9) dt.21-07-2016 2/2 complainant but the complainant was not found on her address and she did not appear.
Taking into consideration that petitioner no. 1 denied his marriage with the complainant, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Complaint Case No. 705 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
