JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 10.09.2016 in connection with Bihar P.S. Case No. 401 of 2016, registered for offences punishable under Section 25(1-B)A, and 26 of the Arms Act.

Allegation is of recovery of two live cartridges from the possession of the petitioner.

It has been submitted on behalf of the petitioner that only two live cartridges along with cash of Rs. 25,200/- has been recovered from the possession of the petitioner. There is no fire arm recovered from the possession of the petitioner. The petitioner has no criminal antecedent and he has been languishing in jail

Patna High Court Cr.Misc. No.49437 of 2016 (2) dt.13-12-2016 2/2 custody since 10.09.2016.

Considering the aforementioned facts and circumstances, the period of custody and also the fact that only two cartridges have been recovered from the petitioner and that too without any fire arm, and also the fact that the petitioner has no criminal antecedent, let the petitioner above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 401 of 2016.
