Petitioners apprehend their arrest in connection with Rajgir P. S. case no. 73/2014 registered under sections 147, 353, 323,149, 337, 307 of the IPC and 135 of the Indian Electricity Act. The accusation against these petitioners is that they attempted to assault the officials of the electricity department when they red handed caught petitioner no.4 and others consuming electricity illegally.
The contention on behalf of the petitioners is that petitioner no.4 has already deposited damaged amount and so far as story of assault on the officials of the electricity department is concerned, the same occurred due to mis-conception.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.51844 of 2014 (2) dt.06-01-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir P. S. case no. 73/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
