JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Barhara (Raghubans Nagar) P.S. Case No. 500 of 2022, registered for the offence punishable under Sections 25(1-b) a, 25, 26 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. Petitioner is in custody since 24.10.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed.

No.22771 of 2023(2) dt.17-05-2023 2/2 Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-2, Barhara in connection with Barhara (Raghubans Nagar) P.S. Case No. 500 of 2022.

This is also subject to the conditions that (i) the petitioner shall mark his presence in Barhara (Raghubans Nagar) Police Station, District- Purnea on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
