JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 498A and 376 of the Indian Penal Code, Sections 3/4 of the Dowry Prohibition Act and Sections 4 and 8 of The Prevention of Children from Sexual Offence, Act.

The prosecution case is that Md. Kamran ravished the informant and thereafter marriage was performed but subsequently he refused to take the informant to the matrimonial house. It is alleged against the petitioners who are the parents and sisters of Md. Kamran that they assaulted the informant and demanded dowry.

Patna High Court Cr.Misc. No.45323 of 2015 (2) dt.23-09-2015 2/2 It is submitted by learned counsel for the petitioners that the thrust of accusation is against Md. Kamran and the petitioners have only been roped in the present case since they happens to be the family members of Md. Kamran.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-Cum-Special Judge, POCSO Act, Bhagalpur in connection with Sultanganj P.S. Case No. 145 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
