JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2018 Petitioners pray for bail in connection with Raniganj P.S.Case No. 323 of 2016 registered for the offences punishable under Sections 147, 148, 149, 342, 302, 307, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against 30 named accused persons, including the petitioners is that they came with deadly weapons and surrounded the informant. It is alleged that accused Shambhu Rishideo hit the brother of informant with arrow blow, due to which he fell down after sustaining injury and when informant came to rescue him he was also assaulted by petitioner No.1 with arrow blow, causing injury to him and it is further alleged that other accused persons assaulted brother of the informant, due to which he succumbed to the injuries.

No.71709 of 2018(2) dt.13-12-2018 2/2 Submission of learned counsel for the petitioners is that there is no specific allegation of assault against the petitioners to the deceased and though there is allegation of assault against petitioner No.1 to the informant but the injury is said to be simple in nature and they are in custody since 22.8.2018.

Having heard both sides and in the facts and circumstances, let petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Araria, in connection with Raniganj P.S.Case No. 323 of 2016, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
