JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with P.S. Jagdishpur P.S. Case No. 176 of 2016, registered under Sections 363, 365/34 of the Indian Penal Code.

The allegation of informant Vishnu Shankar Prasad is that his minor daughter, aged about 16 years, has gone to school on 13.07.2016, but she did not return. On search, the informant came to know from Runi Kumari, friend of his daughter, that his daughter has been enticed away by Ashish Kumar Yadav.

Learned counsel for the petitioner submits that, in fact, there was love affair in between the daughter of the informant and Ashish Kumar Yadav and both were fled away

This fact has also been stated by the victim in her statement recorded under Section 161 Cr.P.C. with further allegation that since this petitioner, who is the mother of Ruhi Kumari, also aware of her love affair and due to that reasons victim was asked to carry ornaments from her house otherwise the matter will be disclosed to her parents. Thereafter, victim handed over ornaments of her grandmother to this petitioner. Further submission is that the while victim has stated in her statement recorded under Section 164 Cr.P.C. that there was love affair between her and Ashish Kumar and this petitioner managed to kidnap her. Further submission is that petitioner is the lady having no criminal antecedent. The petitioner is in custody since 28.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-XI, Bhojpur in connection with Jagdishpur P.S. Case No. 176 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
