2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341/323/354/506/506 of the Indian Penal Code.
3. On the alleged date and time of the occurrence, this petitioner is said to have entered the house and abused the complainant and on protest by her husband, petitioner abused her daughter and also assaulted her husband. It is further alleged that while complainant had gone to sell vegetable, petitioner took the vegetable forcefully.
4. It is submitted on behalf of the petitioner that the complainant is close neighbourer and due to petty dispute
Patna High Court CR. MISC. No.25177 of 2023(3) dt.13-07-2023 2/2 quarrel had taken place between the parties and taking advantage of the situation, this false case has been lodged against the petitioner. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Complaint Case No. 638C of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
