13-12-2016 Heard Sri Bhavesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is a lady and in custody since 28-08-2016 in Special Case No. 61 of 2016, arising out of Bahadurpur P.S. Case No. 148 of 2016, registered for offence under Sections 20 & 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 and Sections 47A & 54 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been arrested on an accusation that from a hut, which was occupied by the petitioner, about 6 litres of country-made liquor, disposable glasses and Ganja weighing 450 Gram was recovered. It was further submitted by learned counsel
Patna High Court Cr.Misc. No.43288 of 2016 (2) dt.13-12-2016 2/2 for the petitioner that it was a false case and petitioner, being lady, may not be allowed to remain in custody for a long time. He has also drawn my attention to the statement made in paragraph - 3 of the petition that petitioner is having clean antecedent. Keeping in view the fact that petitioner is a lady, having clean antecedent and lesser quantity of recovered articles, let the petitioner namely Rehana Khatoon be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Patna in connection with Special Case No. 61 of 2016, arising out of Bahadurpur P.S. Case No. 148 of 2016.
