The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 381 and 120B of the Indian Penal Code.

The informant is proprietor of Kamal Enterprises. Some hardware materials of the informant was allegedly sold by the petitioner, who was storekeeper, and this fact was taken into cognizance only when a Thelawala informed that one Suresh Poddar is selling the material of the informant sold through this petitioner. The case diary would reveal that the police has not verified the stock status of the informant to substantiate that in fact quantity was lesser than the stock register. Hence, there is no

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna City, Patna/Successor Court in connection with Chowk P.S. Case No.170 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
