Petitioner seeks bail in Dumariya P.S. Case No. 37/13 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 307, 353, 335, 427, 120(B) of the Indian Penal Code and Section 17 of the C.L.A. Act.

Accusation is that the petitioner being member of mob attacked the police personnel, pelted stones causing injury and put the vehicle on fire.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. It has further been submitted that there is no specific allegation against the petitioner. Petitioner has no criminal antecedent and he is in custody since 27.07.2018. Similarly placed co-accused persons Punit Singh Bhokta and another have already been granted

Patna High Court Cr.Misc. No.76698 of 2018(2) dt.19-12-2018 2/2 anticipatory bail by a co-ordinate Bench of this Court vide order dated 05.10.2018 passed in Cr. Misc. No.53496 of 2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Dist- Gaya in connection with Dumariya P.S. Case No. 37/13, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
