JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 341, 323, 315, 504, 506/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand and getting the pregnancy of the informant terminated.
The petitioner and the informant are present. It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and the petitioner has entered into compromise with the informant and both decided to party ways. A compromise petition, swore by both the petitioner and the informant, has been filed before the learned court below. The
Patna High Court Cr.Misc. No.44870 of 2015 (10) dt.17-03-2016 2/2 same has been brought on record as annexure-4 to the 4th Supplementary affidavit.
Learned counsel for the informant submits that both sides have decided to part ways, hence, the informant is not opposing the prayer for bail of the petitioner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhubani, in connection with Bisfi (Patauna) P.S. Case No.28/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
