JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners. The petitioners are apprehending their arrest in connection with Mansi P.S. Case No. 144 of 2016, G.R. No. 1629 of 2016, registered for the offences under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the allegation against the petitioners in the F.I.R. is that they manipulated in the register and got mention 2 bigha 14 katha in place of 1 bigha 14 katha land and sold excess land from their share to co-accused persons which was recorded in their names, as such it will appear that there is a civil dispute and no case under Sections 449 , 420 and other sections of the I.P.C. is made out against the petitioners.

Heard the learned APP and the learned counsel for the informant. They have opposed the prayer for bail but not disputed that this case appears to be a civil dispute. Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.4276 of 2017 (2) dt.09-02-2017 2/2 facts, let the petitioners, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 25,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 144 of 2016, G.R. No. 1629 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the further conditions that the petitioners shall co-operate in the trial and make themselves available before the court as and when required and in the event of failure on their part to appear before the court on two consecutive date, without showing any genuine reason, their bail bonds shall be liable to be cancelled.
