The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 366(A), 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and the informant alleges that his minor daughter for marriage was lured by Jitendra Mahto and in the occurrence, they were helped by the petitioner, who is sister of Jitendra Mahto. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that the victim's statement was recorded under Section 164 of the Cr.P.C. wherein she has disclosed her age as

Patna High Court CR. MISC. No.22455 of 2022(2) dt.07-11-2022 2/2 20 years and has not supported the prosecution case. It is next submitted that petitioner being married sister of Jitendra Mahto was falsely implicated.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Gadhpura P. S. Case No.106 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
