JUSTICE BIRENDRA KUMAR ORAL ORDER 13-12-2016 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are accused in connection with Chand P.S. Case No. 77 of 2016 registered under Sections 341, 323, 324, 307 and 504/34 of the I.P.C. and later on, section 302 of the I.P.C. was added.

There is allegation of commission of injury at the head of the informant against petitioner Mahabali Yadav. The coaccused Prakash Yadav caused injury at the head of Sohan Yadav, as a result of which, he died subsequently.

There is general and omnibus allegation against the petitioners and the only allegation against the petitioners Salik Yadav and Jai Ram Yadav is of commission of assault. Petitioners

Patna High Court Cr.Misc. No.40722 of 2016 (3) dt.13-12-2016 2/2 are in custody since 29.07.2016. There is case and counter case in which petitioners' side has also sustained grievous injury. Considering the period already undergone by the petitioners and nature of allegation, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Chand P.S.
