04-12-2018 Heard Sri Ashok Kumar Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Belsand P.S. Case No. 142 of 2018 registered for offence under Section 304 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that though petitioner was not having any connection with the land in question, over which, an electric wire was lying, he has been arrayed as accused, as if, he was bataidar of the field in question. He further submits that in any event, it was accidental death, since electric wire had broken, which was over head of the field in question and it was responsibility of the electricity department, even then, the petitioner has been arrayed as
Patna High Court Cr.Misc. No.72324 of 2018(2) dt.04-12-2018 2/2 accused.
Besides hearing, I have also perused the material on record, particularly the F.I.R. and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.
In the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Budhan Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Belsand P.S. Case No. 142 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
