2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 367, 368, 406, 407, 120B/34 of the Indian Penal Code.
3. As per complaint case, the complainant lodged this case regarding missing of his son. The complainant alleged that the petitioner along with others took away his son by alluring him to provide a job in Gujrat but after sometime, son of informant did not return.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner and the informant are co-villagers and due village politics, he has falsely implicated the petitioner in this case. There is no eye witness of the alleged occurrence. No any
Patna High Court CR. MISC. No.25700 of 2023(4) dt.08-08-2023 2/2 consistent material has come during investigation against the petitioner regarding commission of the alleged offence. It is also submitted vide para 8 of the petition that earlier the petitioner lodged a case in connection with Bhabhua SC/ST P.S. Case No. 04 of 2022 against the husband of the informant and others. The victim/son of the informant has not been traced out as yet. The petitioner has got no criminal antecedent and languishing in judicial custody since 11.2.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chand P.S. Case No. 250 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabhua/concerned Court.
