The petitioner is apprehending his arrest in connection with Dehri P.S.Case No. 457 of 2016 registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code. It has been submitted on behalf of the petitioner that there is allegation of illegal withdrawal of money but the petitioner is a Clerk in the school and he is not drawing and disbursing officer and, as such, whole allegation appears to be false. It has further been submitted that the document annexed with the FIR shows that the District Education Officer has stated that petitioner is a Clerk and he has no information regarding withdrawal of the money. It has further been submitted that the Headmaster of the school, who is drawing and disbursing officer, has already been granted anticipatory bail by this Court in Cr.Misc.No. 50778 of 2016 by order dated 9.1.2017.

Having heard both sides and considering the fact that petitioner is Clerk and not drawing and disbursing officer, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram, in connection with Dehri P.S.Case No. 457 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the conditions that petitioner will cooperate in the investigation and appear before the police, as and when required, and on failure on his part to appear before the police on two consecutive occasions, without showing any valid reason, his bail bond shall be liable to be cancelled.
