JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Supaul P.S. Case No. 462 of 2017 dated 13.08.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 379, 504 of the Indian Penal Code.

The learned counsel for the petitioners has submitted that with respect to the same occurrence, earlier a case was lodged at the instance of the mother of the informant of the present case vide Supaul Mahila P.S. Case No. 110 of 2017 in which the petitioners were

Patna High Court Cr.Misc. No.79850 of 2018(2) dt.16-01-2019 2/3 made accused. In the aforesaid case, the petitioners have been granted bail.

The learned counsel for the petitioners has further pointed out that the sister-in-law of the petitioners has also filed a case against the informant of the present case vide Supaul Mahila P.S. Case No. 109 of 2017 on 12.07.2017 for various offences under the Indian Penal Code as also under Section 3/4 of the Prevention of Witch Practices Act, 1999. It has also been submitted that the dispute was with respect to the water logging which has been given different color and dimension by the respective parties.

Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case
